The "Lemon Laws" as they are often referred to are surprisingly complex and often misunderstood by most lawyers, and even judges. Under California Law (called the Song Beverly Act and the Tanner Consumer Protection Act), a vehicle must be purchased new and in the shop several times for the same substantial defect in order for California "Lemon Law" to apply.
Under Federal Law (called the Magnusson Moss Federal Trade Commission Act) a used vehicle purchased with a warranty comes under the Federal "Lemon Law". However, the remedies a consumer is entitled to under the Federal law are more limited.
Remedies are also available to consumers who have been defrauded, but a fraud case must be proved by "clear and convincing" evidence, which means the consumer usually must have documents showing a fraud has been committed, not just verbal statements.
