FORECLOSURE SERVICES:
The Attorneys and staff at the Law Offices of Robert McCoy are dedicated to assisting those with foreclosure issues. There are many options available to those who may be facing foreclosure, including the following:
Negotiation:
You may have noticed how difficult it is for you to communicate with the bank which is foreclosing on your home. We often can assist in the negotiation of a payback plan. Note that it is extremely important you use an attorney in this process as banks will often take unfair advantage of a homeowner who is not represented by an attorney and coerce the homeowner into signing a harmful, one-sided agreement. We often assist homeowners in getting back their home even after it is sold at a foreclosure sale.
Bankruptcy:
The filing of any chapter bankruptcy will stop the foreclosure of your home. Through a Chapter 13 Bankruptcy, you may enter into a repayment plan to pay back what you owe in order to keep your home.
Civil Litigation:
Most people do not know their rights relating to a foreclosure of their home. Included in these rights is a right to notice of default, notice of sale at least 5 days before the sale date, a right to reinstate what is owed, a right to purchase the loan for what is owed, and a right to receive any excess money available after sale. We can assist you through civil litigation if any of your rights have been violated. Contingency cases are considered on a case by case basis.
